Welcome to TA Art Gallery. These Terms and Conditions ("Terms") govern your access to and use of the TA Art Gallery website located at https://taartgallery.com (the "Site") and all purchases made through it. Please read these Terms carefully before using the Site or placing an order.
By accessing the Site, creating an account, or completing a purchase, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy, Return & Refund Policy, and Shipping Policy, all of which are incorporated herein by reference.
If you do not agree to these Terms, please do not use the Site or place any orders.

Agreement to Terms These Terms constitute a legally binding agreement between you ("Customer", "you", or "your") and TA Art Gallery ("we", "us", or "our"), a business registered and operating from Islamabad, Pakistan. These Terms apply to all visitors, users, and customers of the Site. |

2. Eligibility & Use of the Site
By using the Site, you represent and warrant that:
• You are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian who agrees to these Terms
• You have the legal capacity to enter into a binding contract
• You are not prohibited by applicable law from purchasing the Products offered on the Site
• All information you provide to us — including account details, contact information, and payment details — is accurate, current, and complete
• You will update your information promptly if it changes
We reserve the right to refuse access to the Site, cancel accounts, or reject orders at our sole discretion, including if we believe you have violated these Terms or any applicable law.
3. Account Registration
Certain features of the Site, including placing orders and tracking purchases, may require you to create an Account. When registering, you agree to:
• Provide accurate, complete, and truthful registration information
• Keep your Account credentials — including your password — confidential and secure
• Notify us immediately at taartgalleryofficial@gmail.com if you suspect any unauthorised use of your Account
• Accept responsibility for all activities that occur under your Account
You may not create an Account on behalf of another person without their explicit permission, or impersonate any individual or entity. TA Art Gallery reserves the right to suspend or terminate any Account that violates these Terms.
4. Products & Product Descriptions
We make every effort to ensure that product descriptions, images, dimensions, colours, and specifications displayed on the Site are accurate and up to date. However, we do not warrant that product descriptions or any other Site Content is error-free, complete, or current.
• Product images are for illustrative purposes. Actual colours may vary slightly depending on your screen settings and display calibration
• Dimensions and weights provided are approximate and may have minor variances
• We reserve the right to correct any errors, inaccuracies, or omissions and to update information at any time without prior notice
• Availability of Products is subject to stock levels. We do not guarantee that any Product will be available at the time of your Order

Customised Products For customised or made-to-order items, it is your sole responsibility to review and confirm all customisation details — including names, colours, sizes, and artwork — before submitting your Order. Once a customised Order enters production, it cannot be amended, cancelled, or returned (except in cases of manufacturing defect). |
5. Pricing & Payment
Prices
All prices displayed on the Site are in Pakistani Rupees (PKR) unless otherwise stated. International customers may see prices converted to their local currency for reference purposes; the final charge will be processed in PKR or as displayed at checkout. Prices are inclusive of applicable taxes where stated, but exclusive of shipping charges unless otherwise specified.
We reserve the right to change prices at any time without notice. Price changes will not affect Orders that have already been confirmed.
Payment
Full payment is required at the time of placing your Order. We accept the following payment methods:
• Credit and debit cards (Visa, Mastercard, and other supported networks)
• Shopify Payments and other integrated payment gateways
• PayPal, where available
• Bank transfer or local payment methods, where offered at checkout
All payment transactions are processed through secure, PCI DSS-compliant third-party payment processors. TA Art Gallery does not store your complete payment card details on its servers. By submitting payment, you confirm that you are the authorised cardholder or have permission to use the payment method provided.
Failed or Declined Payments
If your payment is declined, your Order will not be processed. Please verify your payment details or contact your bank. TA Art Gallery is not responsible for any charges, overdraft fees, or penalties incurred as a result of a failed payment attempt.
6. Order Placement & Acceptance
Placing an Order on the Site does not constitute a binding contract. A Contract is only formed when we send you an Order Confirmation email indicating that your Order has been accepted and payment has been successfully processed.
• You will receive an Order Acknowledgement email immediately after submitting your Order — this is confirmation that we have received your Order, not that it has been accepted
• An Order Confirmation email will follow once payment is verified and stock availability is confirmed
• We reserve the right to cancel or decline any Order at our sole discretion, including where a Product is out of stock, a pricing error has occurred, or we suspect fraudulent activity
• If we cancel your Order after payment has been taken, a full refund will be issued to your original payment method within 5–7 business days

Order Cancellation by Customer You may request to cancel your Order within 24 hours of placement, provided it has not yet entered processing or dispatch. To cancel, contact us immediately at taartgalleryofficial@gmail.com with your order number. Customised orders cannot be cancelled once production has commenced. |
7. Shipping & Delivery
All shipping and delivery terms, including processing times, estimated delivery windows, shipping rates, international delivery, tracking, and failed delivery procedures, are governed by our Shipping Policy, available at https://taartgallery.com.
By placing an Order, you agree to the terms set out in our Shipping Policy. Key points include:
• Orders are processed within 1–3 business days after payment confirmation
• Domestic delivery typically takes 3–7 business days; international delivery 7–21 business days
• Risk of loss and title for Products passes to you upon delivery to the confirmed shipping address
• TA Art Gallery is not liable for delays caused by courier services, customs clearance, or events beyond our control
8. Returns, Refunds & Exchanges
All returns, refunds, and exchange requests are governed by our Return & Refund Policy, available at https://taartgallery.com. By placing an Order, you agree to the terms of that policy. Key provisions include:
• Returns are accepted within 7 days of delivery for eligible items in original, unused condition
• Sale items are final sale and strictly non-returnable
• Customised and personalised products are non-returnable, except where proven faulty
• Refunds are issued to the original payment method within 5–10 business days of approval
9. Intellectual Property
All Content on the Site — including but not limited to text, product descriptions, photographs, graphics, logos, icons, audio clips, digital downloads, and software — is the property of TA Art Gallery or its content suppliers and is protected by Pakistani and international intellectual property laws.
You may not, without our prior written consent:
• Copy, reproduce, distribute, publish, or publicly display any Content from the Site
• Modify, adapt, translate, or create derivative works based on Site Content
• Use any Content for commercial purposes or in connection with any competing business
• Remove or alter any copyright, trademark, or other proprietary notices from Content
• Scrape, data-mine, or systematically extract data from the Site using automated tools
The TA Art Gallery name, logo, and all related product names, service names, and slogans are trademarks of TA Art Gallery. Unauthorised use of these marks is strictly prohibited.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes only. This licence does not include any right to resell or commercially exploit the Site or its Content.
10. User Conduct & Prohibited Activities
By using the Site, you agree not to engage in any of the following prohibited activities:
• Using the Site for any unlawful purpose or in violation of any applicable laws or regulations
• Submitting false, misleading, or fraudulent information including during account registration or checkout
• Attempting to gain unauthorised access to any part of the Site, our servers, or any connected systems
• Uploading or transmitting any viruses, malware, or other harmful code
• Engaging in any conduct that could damage, disable, overburden, or impair the Site's functionality
• Using automated bots, scrapers, or crawlers to access, monitor, or copy Site content
• Harassing, threatening, or intimidating other users or our staff
• Impersonating TA Art Gallery, its employees, or any other person or entity
• Attempting to circumvent any security, access control, or anti-fraud measures on the Site
• Using the Site to transmit unsolicited commercial communications (spam)
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including reporting such users to law enforcement authorities.
11. User-Generated Content
The Site may allow you to submit product reviews, comments, photographs, or other content ("User Content"). By submitting User Content, you grant TA Art Gallery a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, publish, translate, and display that content in connection with our business and marketing activities.
You represent and warrant that any User Content you submit:
• Is accurate, truthful, and based on your genuine experience
• Does not infringe the intellectual property rights of any third party
• Does not contain defamatory, offensive, obscene, or unlawful material
• Does not contain personal information of third parties without their consent
We reserve the right to remove, edit, or refuse to publish any User Content at our sole discretion without notice or liability.
12. Third-Party Links & Services
The Site may contain links to third-party websites, services, or platforms — including social media channels, payment processors, and courier tracking portals. These links are provided for your convenience only.
• TA Art Gallery does not endorse, control, or take responsibility for the content, privacy practices, or accuracy of any third-party website
• Your interaction with any third-party website is subject to that website's own terms and conditions and privacy policy
• We are not liable for any loss or damage arising from your use of or reliance on any third-party website or service
The inclusion of any third-party link on the Site does not imply our endorsement or affiliation with the linked website or its operators.
13. Disclaimer of Warranties
The Site and all Products and Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law.
TA Art Gallery expressly disclaims all warranties, including but not limited to:
• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Site will be uninterrupted, error-free, or free of viruses or harmful components
• Warranties regarding the accuracy, reliability, or completeness of any Content on the Site

14. Limitation of Liability
To the fullest extent permitted by applicable law, TA Art Gallery, its owners, directors, employees, agents, suppliers, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with:

• Any Products purchased through the Site
• Any errors, omissions, or inaccuracies in the Site Content
• Any unauthorised access to or alteration of your data
• Any third-party conduct or content linked to or referenced on the Site
• Any loss of profits, revenue, data, goodwill, or other intangible losses
In no event shall our total cumulative liability to you exceed the total amount you paid to us for the specific Product(s) giving rise to the claim, or PKR 10,000 — whichever is lower.
This limitation of liability applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
15. Indemnification
You agree to defend, indemnify, and hold harmless TA Art Gallery, its owners, directors, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:
• Your breach of these Terms or any applicable law or regulation
• Your use of the Site or any Products purchased through it
• Any User Content you submit, post, or transmit through the Site
• Your violation of any third-party rights, including intellectual property or privacy rights
16. Privacy & Data Protection
Our collection, use, storage, and protection of your personal information is governed by our Privacy Policy, available at https://taartgallery.com. By using the Site or placing an Order, you consent to the data practices described in our Privacy Policy.

17. Promotions, Discount Codes & Gift Cards
Promotional Codes & Discounts
• Promotional codes and discount vouchers are subject to their own specific terms, including expiry dates, minimum order values, and eligible Products
• Only one promotional code may be applied per order unless otherwise stated
• Promotional codes cannot be exchanged for cash, combined with other offers, or applied retrospectively to completed orders
• We reserve the right to withdraw or modify any promotion at any time without notice
Gift Cards
• Gift cards are valid for use on the Site only and cannot be exchanged for cash
• Lost, stolen, or damaged gift cards cannot be replaced
• Gift cards have no expiry date unless otherwise stated at the time of purchase
• Remaining gift card balances after a purchase will be saved to your Account for future use
18. Force Majeure
TA Art Gallery shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
• Natural disasters, floods, earthquakes, or extreme weather events
• Acts of God, war, terrorism, civil unrest, or government actions
• Strikes, labour disputes, or industrial action
• Pandemics, epidemics, or public health emergencies
• Internet or telecommunications outages, power failures, or cyberattacks
• Courier or logistics disruptions beyond our direct control
In such circumstances, our obligations will be suspended for the duration of the force majeure event, and we will notify you as soon as reasonably practicable. If the event continues for more than 30 days, either party may terminate the affected Order with a full refund issued to you.
19. Governing Law & Dispute Resolution
Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
Dispute Resolution
In the event of any dispute, we encourage you to first contact us at taartgalleryofficial@gmail.com to seek an amicable resolution. We will endeavour to resolve disputes informally within 15 business days of receiving written notice.
If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of Islamabad, Pakistan for the resolution of any legal proceedings.
20. Amendments to These Terms
TA Art Gallery reserves the right to update, modify, or replace these Terms at any time at our sole discretion. When we make material changes, we will:
• Update the "Last Updated" date at the top of this document
• Post a notice on the Site or send an email notification for significant changes
Your continued use of the Site after any amended Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must stop using the Site immediately.

21. Severability & Waiver
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
No failure or delay by TA Art Gallery in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any breach of these Terms shall not be construed as a waiver of any subsequent breach.
22. Entire Agreement
These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and TA Art Gallery with respect to your use of the Site and the purchase of Products. They supersede all prior agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter herein.
